Swing Trust is an educational and simulation program only and does not provide financial, investment, or trading advice. This Risk Disclosure Statement ("Disclosure") applies to your use of Swing Trust (the "Service"), operated by DrkGrws LLC ("Swing Trust," "we," "us," or "our"), available at swingtrust.com. It is incorporated into and forms part of our Terms of Service. By using the Service, you acknowledge that you have read, understood, and accepted the risks described below.

1. Educational and Simulation Purpose Only Swing Trust provides trading education, instructional content, and a simulated (paper) trading environment. We are not a broker-dealer, investment adviser, financial planner, commodity trading advisor, or financial institution, and we are not registered as such with any regulatory authority. We do not manage money, execute trades on your behalf, hold customer funds, or tell you which securities to trade.

All content — including lessons, strategies, watchlists, session commentary, chart examples, and hypothetical or simulated trades — is provided solely for general educational purposes. It is not personalized advice and does not take into account your individual financial situation, objectives, or risk tolerance.

2. No Investment, Financial, Legal, or Tax Advice Nothing provided through the Service constitutes investment, financial, legal, accounting, or tax advice, or a recommendation or solicitation to buy, sell, or hold any security or to adopt any trading strategy. No Guarantee of Results or Performance Swing Trust makes no promise, guarantee, or representation that you will earn any profit or achieve any particular result from participating in the Program or from applying anything you learn. Any success achieved by instructors, staff, or other members is unique to them and is not typical, and should not be interpreted as a promise or indication of your own results.

5. Hypothetical and Simulated Performance Limitations The simulation environment uses virtual, non-real funds. Simulated or hypothetical performance results have inherent limitations and do not represent actual trading. Because the trades were not actually executed, results may under- or over-compensate for the impact of real market factors such as liquidity, slippage, execution delays, and emotional decision-making under real financial pressure. No representation is made that any account will or is likely to achieve profits or losses similar to those shown in a simulation. Performing well in the simulated environment does not guarantee, predict, or imply that you will perform well when trading real money in live markets.

6. Past Performance Is Not Indicative of Future Results Any past performance — whether real or simulated, and whether presented by us, an instructor, or another member — is not a guarantee of and is not indicative of future results. Market conditions change, and strategies that worked in the past may not work in the future.

7. Your Sole Responsibility You are solely and exclusively responsible for your own trading and investment decisions and for any resulting profits or losses. Any decision you make to trade real money in live markets is made entirely at your own discretion and risk. You agree that neither DrkGrws LLC nor its owners, instructors, employees, or agents will be liable for any trading or investment losses, lost profits, or other damages arising from your use of the Service or your own decisions.

8. Third-Party Brokers, Tools, and Data The Service may reference or link to third-party brokers, trading platforms, data providers, or tools. We do not endorse, control, or take responsibility for any third party, and any relationship you form or transaction you make with a third party is solely between you and that third party. Data and tools may contain errors or delays, and you should independently verify any information before relying on it.

Acknowledgment and Acceptance By enrolling in and using Swing Trust, you acknowledge and agree that: (a) you have read and understood this Risk Disclosure; (b) you understand that trading involves substantial risk of loss; (c) Swing Trust is educational and simulation only and does not provide investment advice; (d) no results are guaranteed; and (e) you accept full responsibility for your own trading and investment decisions.
